Terms and Conditions for Sunshine Pilates
Effective Date: January, 2, 2025

These Terms and Conditions are established by Im Sweaty and I Know It LLC, doing business as Sunshine Pilates (“Sunshine Pilates”), a Florida limited liability company. By purchasing or participating in our services, you agree to comply with the terms outlined below, in accordance with Florida State law governing health studios.

1. Health Studio Registration

Sunshine Pilates is registered with the State of Florida as a Health Studio, Registration No. HS16124.

2. Membership and Class Packs

  • Class Packs are valid for a maximum term of 180 days from the date of purchase.

  • All prepaid classes and sessions within a Class Pack must be used within the 180-day period.

3. Right to Cancellation

Clients are entitled to penalty-free cancellation of their membership within three (3) days of execution, excluding holidays and weekends. Written notice must be emailed directly to Sunshine Pilates at hello@sunshinepilatesfl.com, and a refund of all monies paid will be issued within thirty (30) days, less any prorated fees for services rendered.

  • Cancellation requests for memberships made after the three-day window are not eligible for a refund.

4. Relocation or Closure

If Sunshine Pilates moves its facilities more than ten (10) driving miles or goes out of business, Clients may cancel their contract and receive a prorated refund of unused services. Additional locations opening does not merit such refunds. Temporary closures for repairs, renovations, sale, or any reason other than permanent closure do not constitute going out of business.

5. Disability or Death

Memberships may be canceled if a Client becomes physically unable to participate in services or in the event of their death.

  • Clients or their estates must provide written notice and supporting documentation, such as a physician's certification, to receive a prorated refund of unused services.

  • Refunds will be processed within thirty (30) days of receipt of the notice and required documentation.

6. Prepayment Disclaimer

Should you choose to pay for more than one (1) month of services in advance, be aware that you are paying for future services and assume the risk of losing your money should the health studio cease to operate. Sunshine Pilates is not required by Florida law to provide security for such payments.

7. Class and Session Policies

  • Pre-Registration: Class space is limited, and pre-registration is required to secure a spot. Drop-ins will be accommodated only if space allows.

  • Waitlist: Clients may join a waitlist and will be notified via email if a spot becomes available.

  • Rescheduling and Cancellation:

    • Clients must cancel or reschedule classes through Sunshine Pilates’ online scheduling system at least 12 hours in advance to avoid forfeiting the cost of the session.

    • Failure to cancel within the 12-hour period will result in a class charge being applied to the Class Pack.

    • In cases of emergencies, Sunshine Pilates may waive fees at its discretion.

8. Identification

Clients may be required to provide identification upon entry to Sunshine Pilates. The studio will supply the means for such identification.

9. Liability Waiver

Participation in Sunshine Pilates services involves physical activity and inherent risks. Clients agree to assume all responsibility for injuries or damages incurred during participation and release Sunshine Pilates and its staff from liability.

10. Client Rights

Clients have the right to contact the Florida Department of Agriculture and Consumer Services for information if Sunshine Pilates goes out of business.
